Terms of service

1. Purpose. Loyalti is software as a service that lets businesses run digital loyalty programs.

2. Acceptance. By creating an account, starting a trial or using the app, the person doing so declares that they act on behalf of the business (for example, the café) and have authority to bind it, and accepts these terms on that business's behalf.

3. Account. The business is responsible for its staff accounts and for keeping their credentials confidential.

4. Subscription. The service is billed monthly in advance through Stripe. It can be cancelled at any time, effective at the end of the period.

5. End-customer data. The business acts as data controller and Loyalti as processor, under the data processing agreement (DPA) that forms part of these terms.

6. Acceptable use. Sending marketing without valid consent or using the service for unlawful purposes is prohibited. If the business offers extra stamps for stories or reviews, it is responsible for following each platform's rules (for example, Instagram or Google) and may not make them conditional on a positive opinion.

7. Availability. The service is provided with reasonable care, without a guarantee of uninterrupted availability unless specifically agreed.

8. Liability. Limited to the fees paid in the previous 12 months, except for wilful misconduct or gross negligence.

9. Renewal and cancellation. The subscription renews automatically every month until the business cancels it from “Subscription”. Cancellation takes effect at the end of the paid period and periods already started are not refunded, unless the law requires it.

10. Business content. The business warrants that it holds the rights to the logos, images and texts it uploads. Notices about illegal content or copyright are handled as described on the “Content notices” page.

11. Age. Business accounts may only be created by people aged 18 or over.

12. Governing law. These terms are governed by the laws of Ireland and any dispute is subject to the courts of Ireland.

13. Operator: [to be completed by the operator], [to be completed by the operator], [to be completed by the operator].
